Why should you work with a real estate attorney?

You may not understand why you need a lawyer when you decide you want to buy a home, but there are several good reasons. While the home-buying process seems relatively straightforward, it's not as simple as you think. There are contracts to sign and negotiations to make, all of which your attorney can help you with.

The first reason you should work with an attorney is because you'll be signing a contract. It's vital that you know that the contract adheres to the state laws and specifies any issues that could come up with the use of the property. Your attorney can help write down any contingencies you want to add to the contract and resubmit it to the seller for review.

Another thing your attorney can help with is filing documentation. When you make a purchase, there are several items you need to file from real estate deeds to title information. Your attorney may need to file the documents at the county and state level, and he or she may also need to make sure that the contract and deed meet with state regulations and is legally binding.

If you don't work with an attorney, you risk signing a contract that is not in your best interests. It's your attorney's job to review all documents and facts associated with the purchase. He or she can make sure you're aware of every part of the contract you're signing and what it might imply now or in the future. He or she may also be able to talk to you about judgments or defects already recognized involving the property. This is information you need, and it helps you make the best decisions on your home purchase.
